Divorce in Dallas, Oregon – The Short Version
Dallas is the county seat of Polk County, so the courthouse is literally in the middle of town at 850 Main Street. If you live in Dallas, you do not have to drive anywhere to file. How Divorce Works in Polk County
Oregon is a no-fault dissolution state. You do not need grounds beyond irreconcilable differences. Here is the sequence for a Dallas, OR case:
- Residency. At least one spouse must have lived in Oregon for six months, or you were married in Oregon (ORS 107.075). Almost all Dallas residents qualify.
- File at Polk County Circuit Court, 850 Main Street, Dallas. In person at the clerk’s window, by mail, or via OJD eFile. Fee: $287.
- Serve your spouse. Signed Acceptance of Service or a process server.
- Response period. Your spouse has 30 days after service to file an Answer.
- Temporary orders (if needed). Interim arrangements for custody, support, and the marital home while the case is pending.
- Mediation. Required before trial in most contested custody matters in Polk County.
- Final resolution. Settlement or judgment. Oregon has no mandatory waiting period.
Dallas-Area Divorce Issues
- Rural and agricultural property. Polk County includes farm acreage, timber rights, and rural parcels that require appraisal, not just a Zillow estimate. Oregon’s equitable distribution standard means the value must be established before division. See property division.
- Small town complexities. In Dallas, the judge, both attorneys, and your spouse may all know each other. This does not change how cases are decided, but it is a reality of practicing family law in a smaller county that an experienced Polk County attorney accounts for.
- Proximity to Eola Hills. Like West Salem, the eastern edge of Polk County abuts wine country. Vineyard interests require business valuation.
- Child custody. Dallas School District serves the area. Parenting plans involving the middle and high school, transportation on OR-22, and parents who may be at very different distances from each other need real thought. See Dallas child custody.
- Spousal support. Three Oregon categories. See the spousal support overview.
Polk County Versus Marion County – What is Different
The law is identical. The courthouse, docket, and judges are different. Polk County has significantly lower case volume than Marion County (251 versus 1,138 divorces in 2024), which affects scheduling. If your case requires a hearing, Polk County may schedule differently than Salem. Having an attorney who appears there regularly matters more than it might in a high-volume urban court.

Frequently Asked Questions
Can I file at the Marion County Courthouse instead of driving to Dallas?
No. If you live in Polk County (Dallas, West Salem, Monmouth, Falls City, Independence), your case files at the Polk County Circuit Court in Dallas. Filing at the wrong court will get your petition rejected or dismissed. If you were married in Marion County but live in Polk County, you still file in Polk County.
How long does a Dallas, OR divorce take?
Uncontested: roughly 90 days from filing to final judgment. Oregon has no mandatory waiting period. Contested cases – those with disputed custody, business assets, or rural land values – typically run 8 to 14 months.
We have farmland. How does that get divided?
Oregon is equitable distribution, so the farm or rural parcel gets divided based on appraised value. If it was brought into the marriage by one spouse (separate property), that complicates the division further. Agricultural appraisals take longer than residential ones. We build that into the case timeline.
Is a Dallas divorce cheaper than filing in Salem would be?
The filing fee is the same statewide: $287 per ORS 21.155. Attorney fees depend on the complexity of the case, not the county. Simpler cases cost less. That calculus is the same in Polk County or Marion County.
